Diese Arbeit beleuchtet den wirtschaftlichen und rechtlichen Hintergrund, Fallstricke bei der Bestellung sowie Auswirkungen des Sicherungsrechtes auf den Verkehrs- und Beleihungswert. In commercial lease contracts limited personal servitudes are used increasingly by tenants to secure their investments into a property or location against premature lease termination rights of property buyers in the case of compulsory auctions or sales due to insolvency of the owner. This work examines economic and legal backgrounds of the limited personal servitude, practical problems of its erection as well as its consequences regarding the Market Value and Mortgage Lending Value.
