Synopsis "Dred Scott and the Second Founding"

In 1857, the Supreme Court denied Dred Scott’s claim to freedom and attempted to define Black Americans outside the nation’s constitutional citizenship. The decision did more than decide the fate of one family. It exposed a constitutional crisis that had been building since the founding.Dred Scott and the Second Founding traces that crisis from the compromises of 1787 through slavery’s expansion, the Civil War, emancipation, Reconstruction, and the transformation of American citizenship through the Thirteenth, Fourteenth, and Fifteenth Amendments. At the center of this history are Black Americans themselves, not simply as people acted upon by law, but as soldiers, voters, organizers, litigants, officeholders, families, and citizens who helped reshape the American Republic. The story does not end with Reconstruction. It continues through its retreat, Jim Crow, the struggle for civil rights, and the continuing effort to give constitutional equality real meaning.Dred Scott lost his case. The struggle over freedom and citizenship helped transform the Constitution. Read more
